License to all vs. Access to all

In its Huawei/ZTE decision the ECJ has set out a roadap how the SEP holder and the implementer can – and should – reach an agreement on a FRAND license. In the mean-time national courts have followed and further developed this concept. However, the stage for this framework so far were patent infringement proceedings before national courts. Accordingly, the parties participating in this endeavour were the claimant and the respecitve defendant. In this context the question has been raised whether the SEP holder based on his FRAND declaration is obliged to offer a licence to any willing licensee or if he is only obliged to ensure that any implementer has fair access to the standard. The issue remains unsettled. The presentation aims to shed light on this dicussion both from an anti-trust law and a patent (licence contract) law perspecitve.

Prof. Dr. Mary-Rose McGuire, Universität Osnabrück

Nach dem Abschluss ihres Studiums der Rechtswissenschaften an der Universität Wien hat Frau McGuire zunächst ein Aufbaustudium „Magister des deutschen Rechts“ absolviert und anschließend als Trainee bei Freshfields, Bruckhaus, Deringer in Brüssel gearbeitet. Von 2001-2003 war sie wissenschaftliche Mitarbeiterin am Lehrstuhl für Bürgerliches Recht, Handelsrecht, deutsches und ausländisches Zivilprozessrecht an der Universität Göttingen und hat dort auch promoviert. Im Anschluss an ihr Gerichtsjahr im Sprengel des OLG Wien war sie als akademische Rätin am Lehrstuhl für Bürgerliches Recht, Handels- und Wirtschaftsrecht, deutsches und internationales Zivilprozessrecht an der Universität Osnabrück beschäftigt und hat zugleich in der Study Group on a European Civil Code mitgearbeitet. 2009 hat ihr die Universität Osnabrück die Lehrbefugnis für die Fächer Bürgerliches Recht, Recht des Geistigen Eigentums, Zivilprozessrecht sowie IPR und IZVR erteilt. 2010 erfolgte ein Ruf auf eine W3-Professur für Bürgerliches Recht, Recht des Geistigen Eigentums sowie deutsches und europäisches Verfahrensrecht an der Universität Mannheim, an der sie bis zu ihrem Wechsel nach Osnabrück tätig war.
